TEMPORARY RESIDENCE AND WORK PERMIT RENEWAL PROCESSES

All renewal processes shall be carried out from Spain, without the employees or their family members having to travel to their country of origin. The residence and work permits within the transnational services framework may be renewed solely within the 60 calendar days immediately prior to the expiration of the Residence Permit. These permits shall be renewed yearly up to a total of two years (including the initial permit) unless a current Social Security-related Agreement exists which has been signed by Spain with the country in which the foreign employee’s company is located which stipulates a longer time period. Employee work and residence permits must be renewed 60 calendar days in advance, although they may also be renewed up to 3 months following the expiration date of the valid permit without any penalty action being taken for the violation committed. The dependent work force work and residence permit shall be renewed for a two-year period and shall entitle the holder thereof to carry out any activity anywhere nationwide. Permanent residence shall be granted to those foreigners who provide proof of having legally resided continuously in Spain throughout a five-year period. Family member residence permits shall depend exclusively on the validity of the head of household’s residence permit.


Spanish Immigration

All of the applications for work and residence permits of the Spanish companies not included under the two cases above are filed at these offices.

This process is divided into 3 main phases. The approximate time periods for completing the steps to obtain these permits are detailed in following:
- Work Permit. Generally speaking, the Authorities will issue a decision within approximately three months, although this period will vary depending on the work load at the Foreign Nationals Office at the time.
-Visa Application Filed Through the Pertinent Spanish Consulate in the Employee’s Country of Origin. Following approval of the application in Spain, the employee shall apply for the Visa through the Spanish Consulate in his/her country of origin. The Consulate issues the Visa within one to three weeks.
